In the history of political thought, the relationship between property and power has been a central preoccupation. The very nature of private property, on many accounts, is to put owners in a position of self-serving power to make decisions about matters of concern to others. In many legal systems, the vast power of owners is pervasive, as an ever greater range of resources is brought within the property regime and subjected to private power backed by the coercive power of the (...) state. Political and legal philosophers have long puzzled over how to reconcile the nature of private property with the limits and social responsibilities upon which, at least for some accounts, property’s legitimacy depends. The perennial question, then, is how best to understand the nature of property such that property’s limits can also be accounted for coherently within our legal and constitutional arrangements. Robé’s book Property, Power and Politics provides us with a wide-ranging analysis of property. There is much that we agree with and applaud here. In this contribution we seek to situate a key aspect of his work within this larger context, and to offer a criticism of one element of his view: his rejection of an understanding of ownership as an office. In Robé’s analysis, offices belong in the public sphere, where officeholders are held to account by their constituencies. We argue that Robé’s rejection of the idea of ownership-as-office rests on a misunderstanding of the legal concept of “office.” Moreover, this idea, properly understood, provides sound conceptual support for the normative aims of Robé’s account: to bind property and social responsibility tightly together. Robé’s project to criticize the virtually unlimited power of private owners in the contemporary world is served, not undermined, by understanding property as an office. First, we provide a brief summary of the key elements of Robé’s view of property (Part II). We then introduce a theoretical perspective on property as office as it has been developed in legal theory (Part III). Finally, we argue that this perspective fits better with Robé’s stated purposes than his own rejection of it suggests and raises some questions for future discussion (Part IV). (shrink)

Osteoporosis is characterized by reduced bone density and strength. Bone mass peaks between age 30 and 40 and then declines. This can be accelerated by factors including menopause and insufficient dietary calcium. Hormone replacement therapy (HRT) is currently the standard treatment for osteoporosis. However, growing concern over potential side effects of HRT has driven a search for alternative therapies. A recent report1 reveals a potential alternative to HRT: a gender‐neutral synthetic steroid that increases bone mass and strength without affecting reproductive (...) organs. This compound acts via a novel extranuclear sex steroid receptor signaling mechanism that has important implications for nuclear receptor biology and human health. The attitudes of patients' to consent have changed over the years, but there has been little systematic study of the attitudes of anaesthetists and surgeons in this process. We aimed to describe observations made on the attitudes of medical professionals working in the UK to issues surrounding informed consent.

The executive hypothesis of self-regulation places cognitive information processing at the center of self-regulatory success/failure. While the hypothesis is well supported by cross-sectional studies, no study has tested its primary prediction, that temporary lapses in executive control underlie moments of self-regulatory failure. Here, we conducted a naturalistic experiment investigating whether short-term variation in executive control is associated with momentary self-regulatory outcomes, indicated by negative affect reactivity to everyday stressors. We assessed working memory capacity (WMC) through ultra-brief, ambulatory assessments on smart (...) phones five times per day in a 7-day ecological momentary assessment (EMA) study involving college-aged adults. We found that participants exhibited more negative affect reactivity to stressor exposures during moments when they exhibited lower than usual WMC. Contrary to previous findings, we found no between-person association between WMC and average stress reactivity. We interpret these findings as reflecting the role of executive control in determining one’s effective capacity to self-regulate. (shrink)

The program is designed to facilitate the Federal Energy Regulatory Commission (FERC) license renewal process for US hydropower installations. The discussion reviews the regulatory, legal, and social contexts that give rise to the creation and distribution of AWARE(TM). The principal legal impetus for AWARE(TM) is the Electric Consumer Protection Act (ECPA) of 1986 that directs FERC to give equal consideration to power and non-power resources during relicensing. The software is reviewed in this paper from several perspectives including those of natural resource economics, systems modeling, and the social context within which FERC licensing decisions are made. We examine both the software and its underlying methodology and find significant problems with each. Because of its flaws, AWARE(TM) does little to further ECPA's equal consideration requirement. We find that the conservation and restoration impact of ECPA for US fisheries could be seriously hampered by the widespread use of AWARE(TM). (shrink)

Representation theorems are often taken to provide the foundations for decision theory. First, they are taken to characterize degrees of belief and utilities. Second, they are taken to justify two fundamental rules of rationality: that we should have probabilistic degrees of belief and that we should act as expected utility maximizers. We argue that representation theorems cannot serve either of these foundational purposes, and that recent attempts to defend the foundational importance of representation theorems are unsuccessful. Cauchy’s contribution to the foundations of analysis is often viewed through the lens of developments that occurred some decades later, namely the formalisation of analysis on the basis of the epsilon-delta doctrine in the context of an Archimedean continuum. What does one see if one refrains from viewing Cauchy as if he had read Weierstrass already? One sees, with Felix Klein, a parallel thread for the development of analysis, in the context of an infinitesimal-enriched continuum. One sees, with Emile Borel, (...) the seeds of the theory of rates of growth of functions as developed by Paul du Bois-Reymond. One sees, with E. G. Björling, an infinitesimal definition of the criterion of uniform convergence. Cauchy’s foundational stance is hereby reconsidered. (shrink)

A construction of the real number system based on almost homomorphisms of the integers $\mathbb {Z}$ was proposed by Schanuel, Arthan, and others. We combine such a construction with the ultrapower or limit ultrapower construction to construct the hyperreals out of integers. In fact, any hyperreal field, whose universe is a set, can be obtained by such a one-step construction directly out of integers. Even the maximal (i.e., On -saturated) hyperreal number system described by Kanovei and Reeken (2004) and independently (...) by Ehrlich (2012) can be obtained in this fashion, albeit not in NBG . In NBG , it can be obtained via a one-step construction by means of a definable ultrapower (modulo a suitable definable class ultrafilter). (shrink)

Foundations of Science recently published a rebuttal to a portion of our essay it published 2 years ago. The author, G. Schubring, argues that our 2013 text treated unfairly his 2005 book, Conflicts between generalization, rigor, and intuition. He further argues that our attempt to show that Cauchy is part of a long infinitesimalist tradition confuses text with context and thereby misunderstands the significance of Cauchy’s use of infinitesimals. Here we defend our original analysis of various misconceptions and misinterpretations concerning (...) the history of infinitesimals and, in particular, the role of infinitesimals in Cauchy’s mathematics. We show that Schubring misinterprets Proclus, Leibniz, and Klein on non-Archimedean issues, ignores the Jesuit context of Moigno’s flawed critique of infinitesimals, and misrepresents, to the point of caricature, the pioneering Cauchy scholarship of D. Abraham Robinson’s framework for modern infinitesimals was developed half a century ago. It enables a re-evaluation of the procedures of the pioneers of mathematical analysis. Their procedures have been often viewed through the lens of the success of the Weierstrassian foundations. We propose a view without passing through the lens, by means of proxies for such procedures in the modern theory of infinitesimals. The real accomplishments of calculus and analysis had been based primarily on the elaboration of novel techniques for (...) solving problems rather than a quest for ultimate foundations. It may be hopeless to interpret historical foundations in terms of a punctiform continuum, but arguably it is possible to interpret historical techniques and procedures in terms of modern ones. Our proposed formalisations do not mean that Fermat, Gregory, Leibniz, Euler, and Cauchy were pre-Robinsonians, but rather indicate that Robinson’s framework is more helpful in understanding their procedures than a Weierstrassian framework. The widespread idea that infinitesimals were “eliminated” by the “great triumvirate” of Cantor, Dedekind, and Weierstrass is refuted by an uninterrupted chain of work on infinitesimal-enriched number systems. The elimination claim is an oversimplification created by triumvirate followers, who tend to view the history of analysis as a pre-ordained march toward the radiant future of Weierstrassian epsilontics. In the present text, we document distortions of the history of analysis stemming from the triumvirate ideology of ontological minimalism, which identified the continuum (...) with a single number system. Such anachronistic distortions characterize the received interpretation of Stevin, Leibniz, d’Alembert, Cauchy, and others. (shrink)

The role of responsible leadership—for each leader and as part of a leader’s collective actions—is essential to global competitive success (Doh and Stumpf, Handbook on responsible leadership and governance in global business, 2005 ; Maak and Pless, Responsible leadership, 2006a . Failures in leadership have stimulated interest in understanding “responsible leadership” by researchers and practitioners. Research on responsible leadership draws on stakeholder theory, with employees viewed as a primary stakeholder for the responsible organization (Donaldson and Preston, Acad Manag Rev 20(1):65–91, (...) 1995 ; Freeman, Strategic management: a stakeholder approach, 1984 ; Mitchell et al., Acad Manag Rev 22:853–886, 1997 ; Phillips and Freeman, Stakeholder theory and organizational ethics, 2003 . We define and operationalize responsible leadership from the perspective of employees and their views of the actions of their leaders. Drawing on a comprehensive survey of 28 Indian and global organizations operating in India, we report the results from 4,352 employees on the relationship between responsible leadership, their pride in and satisfaction with their organization, and retention 1 year later. Strong associations were found among these variables suggesting that responsible leadership—employee perceptions of the support they receive from managers, the HR practices, and corporate socially responsible actions—may be an overarching construct that connects them to the organization. We analyze recent criticisms of the use of hyperreal probabilities as expressed by Pruss, Easwaran, Parker, and Williamson. We show that the alleged arbitrariness of hyperreal fields can be avoided by working in the Kanovei–Shelah model or in saturated models. We argue that some of the objections to hyperreal probabilities arise from hidden biases that favor Archimedean models. We discuss the advantage of the hyperreals over transferless fields with infinitesimals. In Paper II we analyze two underdetermination theorems by Pruss and (...) show that they hinge upon parasitic external hyperreal-valued measures, whereas internal hyperfinite measures are not underdetermined. ABSTRACTA probability model is underdetermined when there is no rational reason to assign a particular infinitesimal value as the probability of single events. Pruss claims that hyperreal probabilities are underdetermined. The claim is based upon external hyperreal-valued measures. We show that internal hyperfinite measures are not underdetermined. The importance of internality stems from the fact that Robinson’s transfer principle only applies to internal entities. We also evaluate the claim that transferless ordered fields may have advantages over hyperreals in probabilistic modeling. (...) Never before have philosophers and geographers approached each other's subjects in such a strong spirit of mutual understanding. The result is a concrete exploration of the human-nature relationship that embraces strong normative approaches to environmental problems.

To explore the extent of embeddability of Leibnizian infinitesimal calculus in first-order logic (FOL) and modern frameworks, we propose to set aside ontological issues and focus on pro- cedural questions. This would enable an account of Leibnizian procedures in a framework limited to FOL with a small number of additional ingredients such as the relation of infinite proximity. If, as we argue here, first order logic is indeed suitable for developing modern proxies for the inferential moves found in Leibnizian infinitesimal (...) calculus, then modern infinitesimal frameworks are more appropriate to interpreting Leibnizian infinitesimal calculus than modern Weierstrassian ones. The Anthropic Principle, in use by physicists, astronomers, and cosmologists, is currently under consideration by philosophers. This principle, in its various forms, appeals to man's existence as a constraint on our determination of natural laws and natural constants, as a principle of prediction, and, in its strongest form, as a principle of explanation which sanctions an argument for the universe being a product of design. What I shall endeavour to show here is how this principle, in its various forms, is (...) used in furthering our understanding of cosmology, and why this principle cannot be used as a principle of explanation. There is little reason, in theory or in practice, to expect voter competence to improve dramatically enough to make much of a difference, but there is reason to think that officials? competence can vary enough to make large differences. The first half of the 17th century was a time of intellectual ferment when wars of natural philosophy were echoes of religious wars, as we illustrate by a case study of an apparently innocuous mathematical technique called adequality pioneered by the honorable judge Pierre de Fermat, its relation to indivisibles, as well as to other hocus-pocus. André Weil noted that simple applications of adequality involving polynomials can be treated purely algebraically but more general problems like the cycloid curve cannot be (...) so treated and involve additional tools–leading the mathematician Fermat potentially into troubled waters. Breger attacks Tannery for tampering with Fermat’s manuscript but it is Breger who tampers with Fermat’s procedure by moving all terms to the left-hand side so as to accord better with Breger’s own interpretation emphasizing the double root idea. We provide modern proxies for Fermat’s procedures in terms of relations of infinite proximity as well as the standard part function. (shrink)

Aristotle's Politics is widely recognized as one of the classics of the history of political philosophy, and like every other such masterpiece, it is a work about which there is deep division.

However, throughout his career he regularly lectured on a wide range of moral and political philosophers of the past. This volume collects these previously unpublished lectures.

We analyze the developments in mathematical rigor from the viewpoint of a Burgessian critique of nominalistic reconstructions. We apply such a critique to the reconstruction of infinitesimal analysis accomplished through the efforts of Cantor, Dedekind, and Weierstrass; to the reconstruction of Cauchy’s foundational work associated with the work of Boyer and Grabiner; and to Bishop’s constructivist reconstruction of classical analysis. We examine the effects of a nominalist disposition on historiography, teaching, and research.

One of the most influential scientific treatises in Cauchy's era was J.-L. Lagrange's Mécanique Analytique, the second edition of which came out in 1811, when Cauchy was barely out of his teens. Lagrange opens his treatise with an unequivocal endorsement of infinitesimals. Whether in meta-analysis or single experiments, selecting results based on statistical significance leads to overestimated effect sizes, impeding falsification. We critique a quantitative synthesis that used significance to score and select previously published effects for situation awareness-performance associations. How much does selection using statistical significance quantitatively impact results in a meta-analytic context? We evaluate and compare results using significance-filtered effects versus analyses with all effects as-reported. Endsley reported high predictiveness scores and large positive mean correlations but used atypical methods: the (...) hypothesis was used to select papers and effects. Papers were assigned the maximum predictiveness scores if they contained at-least-one significant effect, yet most papers reported multiple effects, and the number of non-significant effects did not impact the score. Thus, the predictiveness score was rarely less than the maximum. In addition, only significant effects were included in Endsley’s quantitative synthesis. Filtering excluded half of all reported effects, with guaranteed minimum effect sizes based on sample size. Results for filtered compared to as-reported effects clearly diverged. Compared to the mean of as-reported effects, the filtered mean was overestimated by 56%. Furthermore, 92% of the as-reported effects were below the mean of filtered effects. We conclude that outcome-dependent selection of effects is circular, predetermining results and running contrary to the purpose of meta-analysis. Instead of using significance to score and filter effects, meta-analyses should follow established research practices. (shrink)

The immune surveillance theory postulates that spontaneous tumors are normally rejected by the immune system and appear only when they override host‐immune recognition and rejection mechanisms. The present mini‐review describes a spontaneous tumor system, the reticulum cell sarcomas (RCS) in SJL/J mice, that is dependent on host tumor‐specific immune lymphocytes for growth. This continuous tumor‐specific response results in tumor progression and death of the host. This tumor system contradicts the basic concept of immune surveillance. We propose as an explanation that (...) some highly antigenic tumors, like the RCS, may have evolved in a non‐autonomous fashion but, nevertheless, have lost regulatory controls of cell proliferation. In the RCS system, the tumor expresses Class II MHC I‐E like specificities that are not expressed on the host cells and which selectively stimulate a subpopulation of I‐E specific T cells, the Vβ17a+ clonotype, leading to their expansion and continuous nurturing of the tumor via secreted lymphokines. This neoantigenic stimulation bypasses the tumor regulatory response that might have resulted if the tumor had not expressed neo‐antigens. Furthermore, passive administration of anti‐clonotypic antibody to tumor‐bearing mice results in tumor regression and long‐term survival through removal of the tumor reactive T cells. Thus, in this tumor system, immunosuppressive treatments are the prescription for tumor rejection. (shrink)
